A paper writing
purporting to be the last Will & Testament of Lancelot Johnston Decd was
offered for probate and was duly admitted upon the oath of S. E. Brackin &
L. Brown the witnesses thereto and on motion it was ordered to be Recorded.
I Lancelot Johnston
of the County of Caswell and State of North Carolina do make and ordain this as
my last Will and Testament in manner and form following.
In the first place
I direct all my just debts to be paid which are few and of small amount.
Item 2nd I
give and devise to my beloved wife Matilda for her life or widowhood my
homestead tract of land & appurtenances consisting of what is called the
Paymer? lands and the Jones Lands and several small pieces purchased from other
persons containing in all about four hundred & fifty or sixty acres.
to have and to hold this tract of land subject the following conditions that my
son John shall occupy along with his Mother during her life or widowhood my
said homestead tract above specified and after her death the said homestead
tract of land is hereby devised to my son John and James
in fee simple to
their heirs forever. Also I bequeath and devise my tracts of land as the
Garrett & Neal tracts, containing together some four hundred & forty
six acres in the following manner. To my sons George & Robert to them
& their heirs forever, subject to the following limitations, I direct that
my wife Matilda and my son John shall have controll of said lands until my sons
George and Robert shall attain the age of twenty one years and the proceeds and
rents and profits of said lands shall be applied to their maintenance and
education till they attain said age of twenty one years.
3rd Item I give and
bequeath to my wife Matilda all my house & Kitchen furniture of every
description all my crops whatsoever, all my tools, vehicles, cattle,
hogs, horses, mules and stock of every kind for her benefit and that of my
children viz., John, Robert, James, and George.
4th Item I
appoint my sons John & William to be my Executors and direct that they
shall have controll of all my bonds & debts and shall collect them as far
as they are able and distribute the proceeds of said bonds, debts ___? in
following manner, viz, the said proceeds to be distributed equally between my
wife Matilda and sons John, Robert, James & George except that I bequeath
to my Daughter Laura Motley the sum of two thousand dollars to be
collected out of
the Nunally bonds.
5th Item I give and
bequeath to my son James my gold watch & chain but direct that my son John
shall have control of said watch & chain till my son James shall reach the
age of sixteen years at which age he shall have possession of said watch &
chain.
6th Item I direct
that my Executors shall receive no commission for their trouble in collecting
the sums due me on the aforesaid bonds, and also I bequeath to wife Matilda the
sum of two hundred dollars in Species which I have on hand now at time of
making this my will---
